The relevance of the study is determined by Federal Law No. 514-FL of December 28, 2024, "On Amendments to Article 238 of the Criminal Code of the Russian Federation," which provides for liability for the production, storage, transportation, or sale of goods and products, performance of work, or provision of services that do not meet safety requirements. The subject of this study is certain provisions of Federal Law No. 323-FL of November 21, 2011, "On the Fundamentals of Health Protection for Citizens in the Russian Federation" in relation to current criminal legislation. The objective of the study is to formulate proposals aimed at improving the legal regulation of medical practice. The hypothesis of the study is the assumption of a positive influence of the proposals formulated in the article on the spec-ification of the normative definition of individual elements of medical activity, in particular, in dentistry. Materials and Methods. The study's materials included provisions of the Criminal Code of the Russian Federation, Federal Law No. 323-FL, other legislative and regulatory acts, and questionnaire data from 100 dentists. The study utilized methods of analysis, syn-thesis, and questionnaire surveys. Results of the study, their discussion, and conclusions. The definitions of "medical care" and "medical service" formulated in Article 2 of Federal Law No. 323-FL do not allow for a distinction between these types of medical activity, and it lacks a regulatory definition of the concept of "safety of medical activity." These shortcomings may significantly affect the correct classification of the crime provided for in Article 238 of the Criminal Code of the Rus-sian Federation. Article 70 of Federal Law No. 323-FL does not allow for a clear understanding of the organizational and managerial functions of the attending physician and their status as a public official. Most dentists recognize the importance of changes to the legislative act. The main conclusion is the need to amend Federal Law No. 323-FL.
