Актуальность. Совершенствование правового регулирования информированного добровольного согласия на медицинское вмешательство сохраняет свою актуальность, поскольку положения ч. 1 ст. 20 Федерального закона от 21 ноября 2011 г. N 323-ФЗ «Об основах охраны здоровья граждан в Российской Федерации» оставляют возможность для их широкого толкования. Основная цель работы. Сформулировать предложения, направленные на совершенствование правового регулирования информированного добровольного согласия гражданина или его законного представителя на медицинское вмешательство. Используемые подходы. Изучение положений законодательных и подзаконных актов, анализ научных статей. Анкетирование 100 респондентов – 50 врачей-стоматологов и 50 пациентов. Полученные результаты. Отмечена правовая неопределенность в установлении субъекта получения информированного добровольного согласия на медицинское вмешательство и понятия «полноты» информации. Большинство пациентов (80%) и врачей-стоматологов (98%) считают, что уполномоченному федеральному органу исполнительной власти следует утвердить примерную форму информированного добровольного согласия на медицинское (стоматологическое) вмешательство. Основные выводы. Законодателю необходимо конкретизировать положения о субъекте информирования и качественных характеристик информации. Субъектом информирования о медицинском вмешательстве может быть лишь лицо, имеющее высшее или среднее медицинское образование, осуществляющее конкретное медицинское вмешательство. Для обсуждения предлагается следующий вариант изложения ч. 1 ст. 20 Федерального закона № 323-ФЗ: «Необходимым предварительным условием медицинского вмешательства является дача информированного добровольного согласия гражданина или его законного представителя на медицинское вмешательство на основании предоставленной физическим лицом, имеющим высшее и среднее медицинское образование, непосредственно осуществляющим конкретное медицинское вмешательство, в доступной форме необходимой, достоверной, достаточной информации о целях, методах оказания медицинской помощи, связанном с ними риске, возможных вариантах медицинского вмешательства, о его последствиях, а также о предполагаемых результатах оказания медицинской помощи».

Relevance. Improving the legal regulation of informed voluntary consent to medical intervention remains relevant, since the provisions of Part 1 of Article 20 of the Federal Law of November 21, 2011 N 323-FZ "On the Fundamentals of Health Protection of Citizens in the Russian Federation" leave room for their broad interpretation. The main objective of the work. To formulate proposals aimed at improving the legal regulation of informed voluntary consent of a citizen or her legal representative to medical intervention. Approaches used. Study of provisions of legislative acts and by-laws, analysis of scientific articles. Questioning of 100 respondents – 50 dentists and 50 patients. Results obtained. Legal uncertainty in establishing the subject of obtaining informed voluntary consent for medical intervention and the concept of "completeness" of information is noted. The majority of patients (80%) and dentists (98%) believe that the authorized federal executive body should approve a sample form of informed voluntary consent for medical (dental) intervention. Main conclusions. The legislator needs to specify the provisions of legislative acts on the subject of informing and the qualitative characteristics of information. The subject of informing about medical intervention can only be a person with higher or secondary medical education, who carries out a specific medical intervention. The following version of Part 1 of Article 20 of Federal Law No. 323-FZ is proposed for discussion: "A necessary preliminary condition for medical intervention is the provision of informed voluntary consent of a citizen or her legal representative to medical intervention on the basis of necessary, reliable, sufficient information about the goals, methods of providing medical care, the risk associated with them, possible options for medical intervention, its consequences, as well as the expected results of providing medical care, provided in an accessible form by an individual with higher or secondary medical education, who directly carries out a specific medical intervention."
